A 34-year-old man tragically lost his life after being run over by a skid steer loader operated by a co-worker after hours. He later succumbed to his injuries in the hospital.

HSG Developments Pty Ltd and HSG Asphalt Pty Ltd are each facing a charge under section 21(1) of the Occupational Health and Safety (OHS) Act for failing, as far as reasonably practicable, to ensure a safe work environment.

WorkSafe has accused the companies of violating section 21(2)(a) of the OHS Act by not implementing a secure system for storing the operating keys of machinery, including the skid steer loader. This failure allegedly allowed untrained or unauthorized individuals to gain access to the equipment.

Additionally, both companies face an extra charge under section 23(1) of the OHS Act for not safeguarding the health and safety of non-employees.

The case is scheduled for a filing hearing in the Melbourne Magistrates’ Court on September 2, 2024.
